Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HeavyHub website, marketplace, and related services (collectively, the "Platform"), operated by HeavyHub ("HeavyHub", "we", "us", or "our"). By creating an account, listing equipment, booking equipment, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

HeavyHub connects equipment suppliers ("Suppliers") who list heavy equipment for rent with customers ("Customers") who wish to book that equipment (together, "Users"). HeavyHub facilitates discovery, booking, and live tracking of rented equipment; it does not itself own, operate, or provide the equipment listed on the Platform unless expressly stated.

You must be at least 18 years old and capable of entering into a binding contract under Indian law to use the Platform. If you are registering on behalf of a business, you represent that you have the authority to bind that business to these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at the contact details below if you suspect unauthorized use of your account.

You agree to provide accurate, current, and complete information during registration and to keep that information up to date, including business registration, GST, and identity or address-proof documents where the Platform requests them for verification purposes.

Suppliers are solely responsible for the accuracy of their equipment listings, including machine type, specifications, condition, availability, and pricing. HeavyHub does not independently verify every claim made in a listing and is not liable for inaccuracies in Supplier-provided content, though we may remove listings that appear misleading or that violate these Terms.

A booking request submitted through the Platform is an offer to rent equipment on the stated terms. A booking is confirmed only when a Supplier accepts it through the Platform. Either party may set cancellation terms for a given booking, which will be displayed at the time of booking; absent an agreed alternative, cancellations are handled in good faith between the two parties with HeavyHub support available to mediate disputes.

Customers are responsible for providing a safe, lawful, and accessible worksite for equipment delivery, operation, and pickup, and for complying with all applicable safety and regulatory requirements while equipment is on site.

Equipment rented through the Platform may be fitted with a GPS tracking device that reports location, movement status, engine hours, and fuel level ("Telemetry Data") for the duration of the rental period. Telemetry Data is made available to both the Supplier and the Customer associated with that rental so both parties can verify the equipment's status and usage.

Telemetry Data is collected only from equipment while it is an active listing on the Platform and, for a given unit, only for the duration it is rented or otherwise made available for tracking by the Supplier. HeavyHub does not track individual drivers or operators beyond what is necessary to report equipment location and status.

Telemetry Data may be delayed, incomplete, or temporarily unavailable due to network conditions, device malfunction, or environmental factors, and HeavyHub does not guarantee continuous, real-time accuracy. Telemetry Data should not be relied upon as the sole basis for safety-critical or legal decisions.

Where the Platform facilitates payment between Customers and Suppliers, applicable rental charges, platform fees, and any taxes will be disclosed before a booking is confirmed. HeavyHub may charge Suppliers a commission or subscription fee for use of the Platform and its tracking features, as separately communicated.

All fees are quoted in Indian Rupees (INR) unless stated otherwise and are inclusive or exclusive of applicable GST as indicated at checkout.

You agree not to: (a) list equipment you do not own, operate, or have authority to rent out; (b) submit false, misleading, or duplicate listings or bookings; (c) attempt to circumvent the Platform's booking or payment process to avoid applicable fees; (d) interfere with, disable, or reverse-engineer the Platform's tracking or software systems; (e) use the Platform for any unlawful purpose or in violation of applicable Indian law.

The Platform is provided on an "as is" and "as available" basis. HeavyHub acts as an intermediary connecting Suppliers and Customers and, except where it directly owns and operates equipment, is not a party to the rental agreement between them. HeavyHub does not guarantee the condition, safety, or fitness for purpose of any listed equipment.

To the maximum extent permitted by law, HeavyHub's aggregate liability arising out of or relating to your use of the Platform shall not exceed the fees paid by you to HeavyHub in the three months preceding the claim. HeavyHub is not liable for indirect, incidental, or consequential damages, including lost profits or lost rental income.

We may suspend or terminate your access to the Platform if you violate these Terms, provide false information, or engage in conduct that harms other Users or the Platform. You may close your account at any time by contacting us; obligations arising from bookings already in progress will survive account closure until resolved.

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, subject to good-faith efforts to resolve the dispute informally first.

We may update these Terms from time to time. Material changes will be notified through the Platform or by email ahead of taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
